As we progress on from the recent legalization of marriage for same sex couples New York Attorney General Eric Schneiderman has filed a brief to overturn the Defense of Marriage Act.
As the New York Times report states this is in conjunction with an existing case where a surving same sex partner was required to pay federal estate taxes on the estate both she and her partner had taken so long to build.
This is a dilemma for many same sex couples. We cannot currently collect most federal benefits guaranteed to heterosexual couples including property, social security, and many others.
